1. TERMS AND CONDITIONS
Your luggage storage agreement is settled with the company RITA HOLIDAYS SL, with TAX ID. No. B93573921, owner of the name BAGSCARE and of the website www.bagscare.es , which accepts the deposit. With your luggage deposit, you accept our terms and conditions regarding the luggage storage agreement, on your behalf and / or on behalf of any other interested party, regardless of whether or not it has signed our deposit slip. Our terms and conditions are of general application and all possible amendments shall be agreed in writing and with the management’s approval. In the case of luggage storage with oral or written instructions that are in con ict or that are incompatible with our terms and conditions and have not been authorized and approved by us in writing, we will not be bound by those instructions.
2. DESCRIPTION OF THE SERVICE
The luggage storage service consists of keeping your luggage in our facilities for the period stated in the deposit slip and speci cally from the day and time of delivery, until the expected date and time of collection.
Opening hours to the public are from Monday to Sunday from 9.30 to 20.00 without exception.
3. SUBJECT OF DEPOSIT (LUGGAGE ACCEPTED AT THE LUGGAGE STORAGE)
At the time of deposit, the CUSTOMER must declare the contents of the luggage, stating that the luggage is not among those not accepted for deposit under point 6.
Suitcases and bags, baskets, backpacks and the like will be accepted in storage, within the limit of the storage capacity of each shelf. Each package must be securely closed.
In any case, the company shall not answer for the money, jewelry, precious metals or business documents or other valuables contained in each package that, as stated in point 6, cannot be deposited.
The luggage / package is left in custody at the request of the owners or the representative thereof, as well as of the material owner of the luggage.
The company is entitled, at its discretion, not to accept the luggage/ package in the luggage storage service.
4. STORAGE DOCUMENT (BAGGAGE / LUGGAGE INTRODUCTION PROCEEDINGS)
At the time of the luggage/ packages storage, the employee must ll in the deposit slip.
The original document, with consecutive numbering, shall remain at the luggage storage service; a sheet of paper (receipt), with the same serial number of the original document, shall be delivered to the CUSTOMER; another sheet of paper (receipt copy) will remain in the possession of BAGSCARE. The suitcase will be introduced into the storage service and will be assigned a number.
The company’s employee is not obligated to verify the identity of those requesting the deposit. The CUSTOMER must pay the fee at the time of delivery of the deposited object, upon submission of the corresponding receipt.
5. PACKAGING SERVICE. BAGSCARE offers a packing service for all types of objects according to the fees set forth in a separate annex.
6. FORBIDDEN AND DANGEROUS OBJECTS (BAGGAGE NOT ACCEPTED IN STORAGE).
The following shall not be accepted in storage:
a) Luggage / packages containing ammable or highly fragile materials, exhaling bad odors or that may cause the deterioration of the store infrastructure or damage to other luggage / packages in storage.
b) Money, jewelry, precious metals, samples or business documents and valuables in general. Luggage / packages in bad condition may be rejected, except for special cases, provided that the CUSTOMER declares it in writing, exonerating the company from any responsibility in relation to the poor condition and / or impairment thereof. In that case, upon receipt, BAGSCARE will call the CUSTOMER’s attention on the de ciencies observed, minutely detailing them in the delivery slip (Ref. Item 4.).
7. RIGHT OF INSPECTION (ACCESS TO THE LUGGAGE STORAGE FOR REASONS OF SERVICE)
Access to the storage shall always be allowed to BAGSCARE employees responsible for the service control and management and to the Police or State or Local law enforcement forces, providing the request is reasoned in writing and for security reasons.
8. CUSTODY (PERSON IN CHARGE OF THE STORAGE
The deposit and custody of the luggage / packages is managed by the personnel of BAGSCARE. The sta must comply with and enforce the rules related to the exercise of the deposit and storage of the luggage / packages; the sta may collect the amounts corresponding to the storage, sign the receipts and perform all operations and actions under this Regulation.
The company is not responsible for the natural malfunction and deterioration of the luggage / packages deposited under its direct custody and not attributable to its activity or to causes related to the conservation in the deposit. BAGSCARE shall not be liable for damages or losses due to force majeure and / or natural events, such as earthquakes, oods, etc. BAGSCARE will not answer for undeclared contents by the depositor.
Each piece of luggage / package delivered in the premises of the company is covered by insurance up to a maximum of € 200 per package. This insurance covers any damage and / or loss directly attributable to BAGSCARE company within the limits set forth above, as well as theft by third parties.
Said insurance shall not cover precious gems or metals, watches, plasma displays, LCD, GPS navigators, mobile phones, computers, tablets, jewelry, money, glass, porcelain, artwork, antiques, documents or lm, tapes, records, memory cards or any other medium containing data or images.
The options mentioned above do not cover breakage of handles and / or wheels.
11. CLAIMS AND COMPLAINTS
This establishment has a “complaint/claim” book available to the consumer.
12. FEES AND PAYMENT
The fees for storage and custody of luggage/packages will be set by the company BAGSCARE.
Fees are displayed in a visible way to the public witthin the premises and are specified below:

13. WITHDRAWAL AND STORAGE (LUGGAGE RESTITUTION MODALITY)
The packages in storage shall be returned to the receipt holder, after the payment of the deposit amount. Should the packages have been in storage for a period longer than that corresponding to the minimum fee, the amount to be paid will be estimated according to the fees in point 12 above.
The person in charge of the storage service must check, at the time of the return, only the correspondence of the receipt exhibited by the person collecting the luggage and not the identity of the exhibitor; however, if the storage officer holds reasonable doubts that the receipt holder may not be the legitimate owner of the packages, he must suspend the return and ask the holder of the receipt for the necessary proof of guarantee. Failing that, the packages will remain in storage until the fulfillment of the necessary verifications.
After 60 days from the date of collection declared at the time of deposit, unclaimed packages shall be deemed abandoned and the CUSTOMER will lose any right to reimbursement or compensation for them. The company may proceed, at its discretion, to the sale and / or destruction and / or retention of luggage / packages and their contents.
The return of forgotten luggage shall be at the CLIENT’s full expense, including all costs.
BAGSCARE will send the forgotten objects if they are claimed within the stipulated period; in this case the customer will advance all shipping costs, which shall depend on the weight, destination, carrier, etc. with a fixed minimum fee of 200 euros.
14. APPLICABLE LAW (CONDITIONS AND REVISIONS OF THE REGULATIONS)
With the receipt sling the CUSTOMER accepts all the conditions established in this Regulation, copy of which can be requested at the premises of the company BAGSCARE which, reserves the right to amend this Regulation as a result of the di erent situations that may arise in the speci c course of the activity.
The Parties expressly agree to submit to the jurisdiction and courts of Malaga city for any litigation, dispute that may arise regarding the interpretation of this Regulation, expressly waiving any other jurisdiction that may correspond.
According to the Organic Law 15/1999 on Protection of Personal Data, we inform you that your e-mail address is part of a le for which Rita Holydays SL is responsible and whose purpose is sending commercial information on products or services marketed by Bagscare.
